KickVic want to take down fair use images? (Vic Mignogna)

hello and welcome back to come geek 'some if you are new to the channel please like and subscribe for all future content so today's video will be looking at something that Monica rial has posted on Twitter and what could happen because of it so we're going to jump straight into it while is yellow flash the other day put our video regarding Jimmy mash he fired monica reals lawyer once picked up a and with that video so I covered it as well and what we had was that Jimmy washy she was actually replaced from a episode in one of her episodes that she does excuse me and she was replaced for that episode mostly because she was sick that day and a lot of people speculated including myself but I was I actually said and quite a few other people did as well there was a number of reasons that could have been the reason for her to be palton of just our one episode it could have been scheduling conflicts officers she could have been going to conventions or she could we doing signings or it could have been accord dates or she could have been sick which is what it turns out she was sick for that one day and another worse speculation which was I put out there as well this would have been the highest speculation of them all is a she was fired which is not the case so but with this one here though on the actual video that yellow flash pointed out he had a picture of Ballmer as his thumbnail and people have been going after that thumbnail and quite a few others on Twitter in the kick Vic section of Twitter and they're all saying that they should all copyrights a strike them because it's copyrighted material so with this what you have is yellow flashes video thumbnail right by there there is actually a tweet missing but that tweet actually stated well they using copyrighted images surely Funimation consume and then you had Monica rial reply to that one with yep but then this is what Monica rial said underneath it let them use the image makes it that much easier to get it taken down with a winky emoji so with that there that is almost egging on people and trying to say to people go on go make a false copyright claim that's what's happening there and that would make everything and ever included in this thread look extremely bad mostly Funimation won't do it ask for one because Funimation don't want any more hassle at this moment in time only to look at is Anime News Network over the weekend when they decided to put our tweets which threatened someone you know hero hero hey on Twitter saying go on a day you put the video out I dare you and everyone attacked him basically on Twitter the ratio was I think it was something stupid like 3 or 4 likes 6 or 7 retweets and 725 comments that was before that Anime News Network deleted at the tweets because they realized they were fighting a losing battle and out of those 700 comments everyone was going against Anime News Network saying how unprofessional II looked and you really want to file a false copyright claim because even YouTube sided with hero and said no it's fair use and with all these characters being used for thumbnails and vice versa these people are in the public eye a lot of people know him you go on Google and you can find images of anyone there's hundreds of images of me for my past job and obviously my social media team I had there's even stuff on there from my real life this turns them on there because neo you just look for him and you can find them but what Monica rial is just saying that Popeye there makes it that much easier to get it taken down it's to me that's a threat that is from Monica rial and I've just been going in my videos as most of you have noticed because a lot of you actually doing in the comment as well thing about it is I just probe idios and I read what is put out there on the internet from these people yes I do speculations because that's my opinion that's what I think may happen or has happened and always do because of this reason but when you go out there and you're trying to say to people yeah it makes it much easier to get it taken down winky emoji that's basically telling someone to go and false flag it but again with this from here as you can see a hundred and ninety-eight people have liked it's seven retweets and 22 comments but with that one a myself included a lot of us have actually taken that path there we've retweeted it and we've tagged in YouTube and YouTube creators and they've all looked at it we know that for a fact and some people have actually been in touch with YouTube who said yeah it's not gonna happen so we need to get that evidence first I would love to get that so we need to find it I will actually send an email myself to YouTube asking about all of this and they haven't got back to me yet which is kind of sad but obviously there's been a few issues with YouTube with since last night over the last 24 or so hours and a lot of people can log on myself included and you know a lot of people can log into their accounts and it can just even access videos from the main page but I hope to get a response from YouTube I will have that as well in a future video hopefully that if they do apply to me but they seem to be kind of good at replying because I've just sent him emails regarding the old nonsense things that don't really mean that much to a lot of people he's just must have questions myself I've had and they've answered them pretty much early within a couple of days so hopefully and get a reply off them regarding this and asking them about fair use but it's just in this thread alone there is so many people here who were actually going to Monica and saying no you can't really do that because again she's saying it makes damage easy to get taken down so is Monica gonna go to Funimation and say to flag all these videos they use in copyrighted images no she can't do that because someone has actually said oh well Funimation owns these images actually they may own a little bit not the full copyright worldwide you know toy animation and all these people the ones who actually make them and everything else they're the ones who got the full-on copyright so these people just don't seem to realize how the copyright system works it's almost like they've gone from one extreme to the other now kick Vic beginning of the year they were going around how dare you do this how dare you do that they will go on Kiwi farms spreading nonsense spring nonsense on Twitter Facebook doing fake swatting –zz fake pictures fake stories and now they've kind of moved from that over to silencing people on YouTube by flagging their videos and trying to get them taken down because they just do not like their opinion in my eyes that is them trying to censor free speech and these are the people who have gone against Trump and chew other tons of people you know these are the ones who are saying well we want this we want equality but if your opinion is different to mine I'm going to die' platform you because you're wrong I'm right and that's not how the world works and we need as many people as we can to share this and say you want to get it taken down you wanna file false claims go ahead and just wait for the backlash if you are new to the channel please like and subscribe hit that notification bar for future updates and I'll see you lovely faces

So they do realise it works the opposite way right? The amount of times they posted viks face on their tweets posts is far more than the other way around.
They must live in some fantasy world where they are the heroes and bad guys are just bad guys -.-

Within my years alive I've learnt one thing, NOBODY is just good or evil. It's a gray area, sometimes people are like this for a reason, whether the past and/or how they grew up ot the poor or good actions they've chosen. Some people are good but others see it as bad, there is not strictly good or evil side.

If this is how these people see others and themselves, I've got a newsflash for you. That mindset doesn't work, because it makes YOU the bad guy; for thinking there are 2 sides, there aren't.

Because of things like this they won't get a single ounce of mercy when they lose everything. Its gonna Open Season for memes, jokes and other YouTubers to come out the woodwork to cover their downfall.😈

Maybe they think it's not fair use because they backed Believe Bulma, and it got a cease and desist. Of course, they got that mostly because they were trying to make money using official DBS art as their trademark and merchandise.

Hey Monica, the company you work for only has the rights to dub and distribute Dragon Ball anime in the territories it's allowed, they don't full blown own the rights to the anime or the characters as that belongs to Toei Anime and Akira Toriyama. And even if you decide to abuse the copyright system for your nefarious purposes, we'll still call out all your bullshit, because as a certain blue hedgehog put it……NO COPYRIGHT LAW IN THE UNIVERSE IS GONNA STOP ME!

Filing a copyright strike for something is a legal claim that the person/agency filing, has legal ownership or represents the owner as a company representative.

A claim filed by just some asshat is an illegal misrepresentation.

EVEN if the person filing were an employee or contractor… the voice actor who voiced the character, for example… That person has no ownership rights to that character.

So… go ahead and let them file. It'll be just that much more entertaining when they end up in federal court trying to explain why they made a claim of legal ownership against an image they don't own.

Even the actual owners are required by copyright law to make allowance for Fair Use. The image is relevant, de minimus, fair use BECAUSE the voice actor (a disposable contractor) has associated the character and the property with the voice actors insane cultural marxist politics and lysenkoist "listen and believe" gossip mongering.

Corporate policy making can move even slower than the wheels of justice, but… let the SJWs make legal claims of ownership to those images. It has already got Sony pissed off that they're being dragged into this disgusting sandlot drama.

The three stooges of anime already have a suit against them that they can't win.
Funimation has been dragged into it and Sony knows that they aren't far behind.

There are basically two courses they can follow. They can remain silent and sink into the cesspool by slow and painful inches… or thet can pick a side.
All they have to do to stop the sinking is order Funimation to clean house and remove those people acting against the interests of their contractor.

That won't prevent another studio from picking them up, but they'll drag their new contractor into the cesspool with them.

We should therefore encourage their behavior… It will be like giving the industry a much needed enema. They will destroy any studio that touches them.
Studios that require and demand professionalism and a code of civil conduct from their representatives will rise to replace the dead ones.

We will end up with better anime and less bullshit SJW drama.

She just doesn't know what she's talking about and is being a yupper (a yupper is a stupid doglike creature that "speaks" by saying Yup or in Rial's case Yep )

    Upon watching…
It could be construed as her saying that SHE herself is making false claims. Just sayin.

Monica doesn’t have any ground to stand on. She is a voice actor of a company that only dubs anime. Funimation owns the English dialogue and audio. Toei owns every animation. That and the image is 100% fair use. She is a sensitive bitch over those who have different opinions. A person asking a question is harassment in her eyes. A person who sided asked for Monica’s side of the story and she blocked him because of “harassment”.

The whole video isn’t going to be flagged over a thumbnail if the content isn’t copyrighted. YouTube would probably state that if it is copyright claimed the most he could do is to change the thumbnail which is easy.

Let me make this easy for people, if the use of the image wasnt full and clear fair use, NO ONE IN AMERICA CAN CLAIM COPYRIGHT INFRINGMENT BECAUSE NO ONE IN AMERICA OWNS THE COPYRIGHT ON THEM!

She doesn't own the copyright to the image. Funimation doesn't own the copyright to the image. Toei animation owns the imagery, but can't be bothered to send out strikes frivolously.

Isn't it copyright if we claim the character as our own without disclaiming that the image and franchise is owned by Toei animation or something?

while Lacy had a youtube channel full of her vids using OTHER PEOPLES PICs in her thumbnails

Over the weekend I was thinking of writing a letter to ANN's editor. Not to harass but as a person who enjoyed the site and has sat in on their panels but to try and hammer some sense into their heads. And even the CEO issued a apology, he shouldn't apologize to just Hero Hei but also the FANDOM in general. You don't call people "alt-right N" just because they're not walking lockstep with you. You don't know who these people are. You shouldn't just attack people outright. Most of the people you insulted were probably subscribers. And yet after I sat on a panel last years of them explaining about why they haven't able to attract a younger demographic and they don't know why. But now I know why and adding in this nonsense is really going to kill them. And he's still responsible for his other staff members like Zac (and I've known him being an a$$ because I've observed him on forums) and Toole. They owe Clownfish TV and apology and the fans they insulted.
